If you access or use this website (the "Site"), you accept and agree to be bound by and comply with the following terms and conditions (the "Terms").

Jurisdiction

The Site (excluding linked sites, if any) is administered and controlled by Altius Healthcare and its affiliates, subsidiaries, officers, directors, employees or agents (collectively, "Altius Healthcare") in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. You agree that the Site will be governed by and construed in accordance with Ontario law without giving effect to any principles of conflicts of laws. You agree that all disputes, controversies or claims arising out of or in connection with the Site shall be submitted to and be subject to the jurisdiction of the courts of the Province of Ontario, Canada. You submit and attorn to the exclusive jurisdiction of the courts of the Province of Ontario to finally adjudicate or determine any suit, action or proceeding arising out of or in connection with the Site.

Trademarks and other intellectual property rights

"Altius Healthcare" is a registered trademark used under exclusive license by Altius Healthcare. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look" and "feel" and arrangement of such Content, contained on the Site is licensed by Altius Healthcare and is protected by copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws. Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Altius Healthcare's express prior written consent. Altius Healthcare actively and aggressively enforces its intellectual property rights to the fullest extent of the law.

E-mail communication

Any unprotected E-Mail communication over the Internet is, as with communication via any other medium (e.g. cellular phones, post office mail), not confidential, subject to possible interception or loss, and is also subject to possible alteration. Altius Healthcare is not responsible for and will not be liable to you or anyone else for any damages in connection with an e-Mail sent by you to Altius Healthcare an e-mail sent by Altius Healthcare to you at your request.

No endorsements

No endorsement or approval of any third parties or their advice, opinions, information, products or services is expressed or implied by any Information. The omission of any information does not necessarily indicate a lack of endorsement by Altius Healthcare.

Entire agreement

These Terms and any terms incorporated or referred to herein constitute the entire agreement between you and Altius Healthcare relating to the subject matter hereof, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter, and may not be amended or modified except in writing, or by Altius Healthcare making such amendments or modifications in accordance with these Terms.

Severability

These Terms shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
